On the 6th April 2014, the Common Law remedy of distress for rent was removed and replaced with the Commercial Rent Arrears Recovery procedure (CRAR). Section 72 now allows commercial landlords to use Schedule 12 to take control of their goods using the TCE Act to then recover the rent they are due under the lease from the tenant - resulting in no need for court.
